Consider Request by Mayor Pro Tem Napolitano and Councilmember Franklin to Discuss the City's Historic Preservation Regulations (City Manager Moe).
DISCUSS AND PROVIDE DIRECTION
Why doesn't Council just intervene and direct city staff to stop overreaching and tell Bruce Moe to have his staff follow the Historic Preservation Regulations which clearly state, in Section 10.86.090 Owner Consent for Landmark Designation that "The City shall not designate any landmark without owner's consent"? This seems to be a simple solution to a problem of city staff going rogue on this issue by holding up all sorts of older structures for remodeling or demolition simply because of their age and without the consent of the owner as required by the ordinance.
